Our Legal (Construction Law) Committee holds a webinar every other month to discuss with NUCA members current legal topics affecting the utility construction industry and our member's business operations.

The committee is tasked to review, monitor and investigate new trends in contract documents, to alert contractors of potential pitfalls in these documents, and to provide resources on new contract language. Our 2023 webinar series will help members understand the committee's work and the many complex legal issues faced by our members in their operations.

December 19, 2023 Presentation - Liquidated Damages



Our last webinar of 2023, "Liquidated Damages: Strategies to Avoid Assessment," was hosted by industry legal expert Tom Olson. Death, taxes and the assessment of liquidated damages--each occur as inevitable.  And, with regard to liquidated damages (LD), there are tried and trued strategies that have helped contractors limit LD’s.  Tom will share those strategies with you.

May 23, 2023 Presentation - Late Utility Relocation: Tools To Prevent and Get Paid If It Occurs
Late utility relocation is the number cause of delay on highway-heavy projects around the country. Since contractors don’t have contracts with utilities, contractors’ experience is there is nothing they can do to stop it, or otherwise get paid when it occurs. BUT DOES THAT HAVE TO BE SO? The answer is NO. There are tools contractors can use to minimize late relocation and, when it does occur, get paid for the related extra costs. In this seminar, we will identify these tools as well as how to use them.
